As of 1 March 2026, the amendments adopted on 5 August 2025 introduce several changes to the Polish civil procedure, in particular, they allow for taking a significant step towards the digitalisation of Polish civil court proceedings, and they amend the regulations on mediation.
1. COURT SUBMISSIONS IN ELECTRONIC FORM
To some very limited extent, the submissions to Polish courts could already be made by the parties in an online form. This path has been allowed e.g. in an electronic order-for-payment proceedings or at some phases of bankruptcy or restructuring processes. However, the upcoming amendments represent a major step towards more advanced digitalisation of civil and commercial court cases in general.
On 1 March 2026, the new law will enter into force that will allow professional counsels for filing pleadings through the so-called State Courts Information On-line System. This Information System will support the communication in civil and commercial court disputes in Poland. The major new feature is that the Information System will now allow for a two-way communication. Not only will the court be able to send the correspondence through the System (as it has been already possible to a limited extent), but the most significant change is that, at present, the parties will also be able to communicate with the court in this way.
For the first year, the filing of pleadings via the Information System will be optional. This means that professional attorneys will have
a choice between filing pleadings through the Information System and using the traditional way.
Not all pleadings will be allowed to be submitted via the Information System but only those listed by the laws, e.g.:
- pleadings showing the authorization to act on behalf of the party or the withdrawal of the power of attorney,
- notices on change of addresses,
- decisions as to entering into mediation,
- requests for an online court hearings,
- submissions made in challenging proceedings, e.g. in appeals (with some exceptions),
- motions for a written justification of the ruling,
- motions for enforcement clauses (with some exceptions).
