Zamiast za\u015bwiadczenia o braku pierwokupu Skarbu Pa\u0144stwa, zwi\u0105zanego z le\u015bnym charakterem nieruchomo\u015bci, wystarczy teraz o\u015bwiadczenie zbywcy. Nowelizacja budzi kontrowersje, m.in. z uwagi na zwi\u0119kszenie ryzyka niewa\u017cno\u015bci takiej umowy sprzeda\u017cy. Definicja ta generuje szereg w\u0105tpliwo\u015bci, zw\u0142aszcza zwi\u0105zanych z przes\u0142ank\u0105 \u201eprzeznaczenia do zalesienia\u201d. W orzecznictwie dominuje pogl\u0105d, \u017ce przes\u0142anki tej nie mo\u017cna ogranicza\u0107 do przeznaczenia gruntu do zalesienia dokonanego w planie miejscowym lub w warunkach zabudowy. Co wi\u0119cej, na potrzeby innych akt\u00f3w prawnych wprowadzono kolejne definicje. Ustawa o ochronie grunt\u00f3w rolnych i le\u015bnych definiuj\u0105c \u201egrunty le\u015bne\u201d odwo\u0142uje si\u0119 ju\u017c nie tylko do las\u00f3w w rozumieniu ustawy o lasach, ale r\u00f3wnie\u017c do grunt\u00f3w zrekultywowanych dla potrzeb gospodarki le\u015bnej oraz grunt\u00f3w pod drogami dojazdowymi do grunt\u00f3w le\u015bnych.<\/p>\n<p>Skarbowi Pa\u0144stwa (reprezentowanemu przez Lasy Pa\u0144stwowe) przys\u0142uguje ustawowe prawo pierwokupu gruntu: (1) oznaczonego jako las w ewidencji grunt\u00f3w i budynk\u00f3w, lub (2) przeznaczonego do zalesienia okre\u015blonego w miejscowym planie zagospodarowania przestrzennego albo w decyzji o warunkach zabudowy i zagospodarowania terenu, lub (3) stanowi\u0105cego las, obj\u0119ty uproszczonym planem urz\u0105dzenia lasu lub decyzj\u0105 Starosty wydan\u0105 na podstawie inwentaryzacji stanu las\u00f3w. Ustawodawca nie odwo\u0142uje si\u0119 tu do lasu (w rozumieniu ustawy o lasach), ale do danych z ewidencji grunt\u00f3w i budynk\u00f3w (EGIB). Samo w sobie sugeruje to, \u017ce las mo\u017ce nie stanowi\u0107 u\u017cytku le\u015bnego w EGiB (i odwrotnie). Inaczej ustawodawca nie wprowadzi\u0142by takiego rozr\u00f3\u017cnienia. Problem pojawia si\u0119 wtedy, gdy w ewidencji widnieje wpis \u201eLs\u201d, a faktycznie dana nieruchomo\u015b\u0107 z lasem nie ma nic wsp\u00f3lnego.<\/p>\n<p>Wpisy w ewidencji aktualizowane s\u0105 zazwyczaj \u201eprzy okazji\u201d innych czynno\u015bci, w zwi\u0105zku z obowi\u0105zkiem s\u0105d\u00f3w, notariuszy i organ\u00f3w administracji do przekazywania odpowiednich odpis\u00f3w i informacji o dokonanych czynno\u015bciach na cele aktualizacji w ewidencji. Starostowie niech\u0119tnie korzystaj\u0105 z uprawnienia do aktualizacji wpis\u00f3w z urz\u0119du. Zwykle nieegzekwowany jest obowi\u0105zek w\u0142a\u015bcicieli nieruchomo\u015bci do dokonywania zg\u0142osze\u0144 zmiany danych ewidencyjnych. To wszystko powoduje, \u017ce cz\u0119sto stan wpis\u00f3w w EGIB nie pokrywa si\u0119 ze stanem faktycznym.<\/p>\n<p>Za\u0142\u0105cznik do rozporz\u0105dzenia w sprawie ewidencji grunt\u00f3w i budynk\u00f3w do las\u00f3w zalicza grunty okre\u015blone jako \u201elas\u201d w ustawie o lasach. Zgodnie natomiast z odpowiednimi przepisami ustawy prawo geodezyjne i kartograficzne, ewidencj\u0119 grunt\u00f3w i budynk\u00f3w, w cz\u0119\u015bci dotycz\u0105cej las\u00f3w, prowadzi si\u0119 z uwzgl\u0119dnieniem przepis\u00f3w o lasach. Z ustawy tej wynika te\u017c domniemanie aktualno\u015bci wpis\u00f3w w EGIB i \u2013 co do zasady \u2013 wi\u0105\u017c\u0105cy charakter danych z EGIB.<\/p>\n<p><strong>Czy w oparciu o te przepisy geodeta mo\u017ce sporz\u0105dzi\u0107 dokumentacj\u0119 na potrzeby aktualizacji wpis\u00f3w w ewidencji?<\/strong><\/p>\n<p>Formalnie taka droga jest dopuszczalna, ale w praktyce na potrzeby takiej aktualizacji urz\u0119dnicy w starostwach domagaj\u0105 si\u0119 doprowadzenia do zmiany przeznaczenia gruntu na cele niele\u015bne, jak r\u00f3wnie\u017c wy\u0142\u0105czenia gruntu <br \/>z produkcji le\u015bnej. I tak z problemem dochodzimy do \u015bciany, poniewa\u017c zmiana przeznaczenia oraz wy\u0142\u0105czenie gruntu le\u015bnego z produkcji dotyczy grunt\u00f3w le\u015bnych w rozumieniu ustawy o ochronie grunt\u00f3w rolnych i le\u015bnych, a wi\u0119c przede wszystkim las\u00f3w w rozumieniu ustawy o lasach.\u00a0 Przebicie si\u0119 przez t\u0105 \u015bcian\u0119 wymaga\u0142oby prze\u0142amania praktyki organ\u00f3w administracji oraz urz\u0119dnik\u00f3w w Lasach Pa\u0144stwowych.\u00a0<\/p>\n<p><strong>Czyli formalnie jest las, ale jednocze\u015bnie nie ma lasu.
