Nowelizacja wyd\u0142u\u017cy\u0142a okres wstrzymania sprzeda\u017cy nieruchomo\u015bci, ich cz\u0119\u015bci oraz udzia\u0142\u00f3w we wsp\u00f3\u0142w\u0142asno\u015bci nieruchomo\u015bci wchodz\u0105cych w sk\u0142ad Zasobu W\u0142asno\u015bci Rolnej Skarbu Pa\u0144stwa (\u201e<b>Zas\u00f3b<\/b>\u201d) do 20 lat od dnia wej\u015bcia w \u017cycie Ustawy. Oznacza to, \u017ce przez kolejne 10 lat przez Krajowy O\u015brodek Wsparcia Rolnictwa (\u201e<b>KOWR<\/b>\u201d) nie b\u0119dzie prowadzona sprzeda\u017c nieruchomo\u015bci z Zasobu. Sprzeda\u017c dokonana z naruszeniem ustawowego zakazu skutkuje bezwzgl\u0119dn\u0105 niewa\u017cno\u015bci\u0105 umowy.<\/p>\n<p>Przypomnijmy, \u017ce w 2016 r. wprowadzono pi\u0119cioletni zakaz sprzeda\u017cy nieruchomo\u015bci albo ich cz\u0119\u015bci wchodz\u0105cych w sk\u0142ad Zasobu. Nast\u0119pnie nowelizacj\u0105 z dnia 17 marca 2021 r. okres ten zosta\u0142 wyd\u0142u\u017cony do dnia 30 kwietnia 2026 r. Obecna zmiana przed\u0142u\u017ca ochron\u0119 pa\u0144stwowych grunt\u00f3w rolnych a\u017c do dnia 30 kwietnia 2036 r.<\/p>\n<p>Jak czytamy w uzasadnieniu nowelizacji celem wprowadzanych zmian jest zapewnienie d\u0142ugotrwa\u0142ej ochrony grunt\u00f3w rolnych w Polsce przed ich spekulacyjnym wykupywaniem przez podmioty krajowe i zagraniczne, kt\u00f3re nie gwarantuj\u0105 zgodnego z interesem spo\u0142ecznym oraz bezpiecze\u0144stwem \u017cywno\u015bciowym obywateli wykorzystania nabytej ziemi na cele rolnicze. Wstrzymanie sprzeda\u017cy nieruchomo\u015bci obj\u0119tych regulacj\u0105 nie ma jednak charakteru bezwzgl\u0119dnego \u2013 sprzeda\u017c mo\u017ce nast\u0105pi\u0107 po uzyskaniu indywidualnej zgody ministra w\u0142a\u015bciwego do spraw rozwoju wsi, wydawanej na wniosek Dyrektora Generalnego KOWR, je\u017celi przemawiaj\u0105 za tym wzgl\u0119dy spo\u0142eczno-gospodarcze. Poza tym zasady wstrzymania sprzeda\u017cy nieruchomo\u015bci z Zasobu nie dotyczy nieruchomo\u015bci przeznaczonych w miejscowym planie zagospodarowania przestrzennego lub w ostatecznych decyzjach o warunkach zabudowy lub planie og\u00f3lnym gminy na cele inne ni\u017c rolne. Wy\u0142\u0105czenie obejmuje r\u00f3wnie\u017c nieruchomo\u015bci po\u0142o\u017cone w granicach specjalnych stref ekonomicznych. Warto doda\u0107, \u017ce do sprzeda\u017cy nieruchomo\u015bci rolnych znajduj\u0105cych si\u0119 w Zasobie nie stosuje si\u0119 przepis\u00f3w ustawy o kszta\u0142towaniu ustroje rolnego (\u201e<b>UKUR<\/b>\u201d). Wynikaj\u0105ce z niej ograniczenia w obrocie takie jak zakaz sprzeda\u017cy na rzecz podmiotu innego ni\u017c rolnik indywidualny bez zgody KOWR czy pierwokup KOWR, dotycz\u0105 obrotem nieruchomo\u015bciami rolnymi na rynku \u201eprywatnym\u201d. Tym samym nowego 5 \u2013 hektarowego limitu, od kt\u00f3rego obowi\u0105zuje zakaz sprzeda\u017cy nieruchomo\u015bci z Zasobu, nie nale\u017cy myli\u0107 z limitem powierzchni, od kt\u00f3rego obowi\u0105zuj\u0105 ograniczenia obrotu \u201eprywatnymi\u201d nieruchomo\u015bciami rolnymi wynikaj\u0105ce z UKUR &#8211; te co do zasady wci\u0105\u017c dotycz\u0105 \u201eprywatnych\u201d nieruchomo\u015bci rolnych o powierzchni od 1 ha.<\/p>\n<p>Nowelizacj\u0119 nale\u017cy zatem postrzega\u0107 przede wszystkim jako kontynuacj\u0119 dotychczasowej polityki reglamentacyjnej, kt\u00f3rej zasadniczym celem pozostaje ograniczanie zagro\u017ce\u0144 zwi\u0105zanych z inwestycyjnym przejmowaniem nieruchomo\u015bci rolnych.
